RENTAL

Bookings are made on behalf of the owner of the property at the prices stated in the web pages of Rent in Tuscany, www.Rent-in-Tuscany.com, (from now on RIT), 945 Deer Park Road, Saint Helena, California, 94574, United States. These prices are based on market conditions applicable at the time of the rental offer.


HOW TO BOOK

Customers choose a property from our web site and submit an availability form. Once dates and availability have been confirmed the holidaymaker makes his booking directly with RIT through RIT’s booking form.

There is a 30% deposit payable on booking and the balance must be paid 10 weeks before arrival. Bookings made within 10 weeks of arrival are deemed as late bookings, in this case it may be necessary to pay the balance immediately either to RIT, or to the owner, in the form of a credit card transaction or wire transfer.

Once RIT receives your booking form, the property will be held for 7 days awaiting receipt of down payment. Until the booking form is received the property will not be put on hold, unless you request us to do so in order to make final arrangements for your trip. Please e-mail info@rent-in-tuscany.com if you require holding the property for three days or if you have any questions regarding your booking.


PAYMENTS

In order to book a property, RIT, in representation of the owner of the property, or sometimes the owner of the property, must receive a down payment of 30% of the full rental cost, should the booking occur prior to 10 weeks before arrival, otherwise, full payment is required at the time of booking. Please read exceptions below.

Upon receipt of the payment of the prepayment the holidaymaker will be sent full contact details for the property owner or his representative and instructions as to how and when to arrive, you will also be advised of the balance and due date. It is important that you check all the details shown on the confirmation notice carefully to ensure they are correct as this forms the basis of the contract. If the balance payment is not received on time, the booking will be considered as “pending cancellation” until the balance payment or a written cancellation from the client is received. Confirmation and all details will be sent to the person in the group making the booking. This person should be over 18 years of age and have the authority from all persons in the group to make the booking. The names of all people in the group should be listed on the booking form.


SPECIAL PAYMENTS & BOOKINGS

In some instances, properties have tighter booking and rental policies that the ones RIT enforces. Listed below are the exceptions:

Casamora: All rentals at Casamora, including all villas and suites, and Villa Le Magnolie, require a 50% down-payment at the time of booking and the balance 10 weeks prior to vacation rental.


Villa Lo Spino, Contessa & Barona: The property owners require a 50% down-payment at the time of booking and the balance 7 weeks prior to vacation rental.


PAYMENT BY CREDIT CARD

At Rent in Tuscany we accept credit card payments in conjunction with Pay Pal. A charge of 5% is added to all prices when paying by this method. We also accept payments by wire transfer (full details at the time of booking) or by check.


PRICES

RIT, reserves the right to modify the prices in the price list when necessary.


PRIVACY AND DATA PROTECTION

In order to complete your booking we require some personal details from you. We will only use this information in order to complete your booking and undertake to keep personal details confidential. If you do not wish to receive any details of offers or promotions please indicate so on the booking form.


INSURANCE

RIT strongly advises all tenants to consider insurance needs in relation to travel, accident, medical and personal cover. RIT, can not accept liability for any accident, injury, loss or damage sustained by tenants. British residents are advised to complete a form E1.11 obtained from their local post office before travelling and bring it with them. This entitles the holder to benefit from reciprocal health agreements, which exist between certain European countries


MINIMUM RENTAL OR LETTING PERIOD

The minimum rental period is generally one week, from Saturday to Saturday.


ARRIVAL AND DEPARTURE

Unless otherwise indicated in the description of the property, the arrival/departure must take place as follows:

• Arrival: Saturday between 5 p.m. and 8 p.m.
• Departure: Saturday between 8 a.m. and 10 a.m.

Each change to the arrival date and arrival time must be advised and agreed upon with RIT, and be approved by RIT, at least one week in advance. In case of unavoidable delay on the Saturday of arrival, the holidaymaker must call RIT, immediately to +39 0577 355 255 or to +39 348 154 3810. In the event that the owner or his representative are not available and it is not possible to advise the owner or his representative of a late arrival, in the event that the late arrival was not previously advised of or in the event that the owner cannot accept a late arrival, the holidaymaker alone is responsible for the cost of the overnight stay in a hotel. The owner or his representatives who are then obliged to make an unplanned displacement to the property are entitled to claim from the holidaymaker the reimbursement of their expenses.


UPON ARRIVAL

Upon arrival the holidaymaker must present his rental confirmation as well as his passport or identity card to the owner or his representative to enable them to proceed with their registration in accordance with Italian legal requirements.


SECURITY DEPOSIT

Most property owners require the payment of a security deposit for breakages. This is usually payable in cash (euros) on arrival. It will be held and returned to you at the end of your stay. In some instances RIT, may act as a fiduciary figure by receiving the payment via wire transfer or credit card at the time of the fulfilment of the rental payment. This amount will be refunded at the end of the holiday less any deductions made for damage caused to the property or for any additional costs that were not included in the rental price. THE OWNER OR HIS REPRESENTATIVE CAN REFUSE ACCESS TO THE PROPERTY IF THE SECURITY DEPOSIT HAS NOT BEEN PAID. RIT, declines all responsibility in the event of a dispute between the holidaymaker and the owner regarding the deposit. Guests are kindly asked to leave the apartments in a clean, orderly condition. If the apartment requires additional cleaning, it is at the discretion of the owner to make an additional charge and deduct this from the deposit paid.


NUMBER OF PERSONS/SUBSTITUTIONS - PETS

Only guests listed on the booking form and whose names have been registered with the authorities may use the property. The number of persons (adults and children) must not exceed the number of sleeping places indicated in the web pages except in the case of infants (less than 2 years old) provided that the holidaymaker has requested a travel cot or brings their own travel cot and its relevant bed-linen. Any other exceptions are stated in the web pages. The substitution of persons during the rental period is forbidden unless previously agreed with RIT. The holidaymaker is obliged to advise RIT, at the time of booking if he is bringing any pets with him and he should communicate numbers and size. Pets will be admitted only under request to RIT and only for those properties that specify a policy of acceptance of pets. It is compulsory for the holidaymaker to supervise his pet(s) within the communal areas of the accommodation.


ORDER CLEANING

The properties will be handed over clean and tidy and in good working order. During the vacation sojourn the cleaning of the kitchen corner/the kitchen/the kitchenette such as dirty dishes etc or the removal of rubbish, are the customer's responsibility. If this has not been done, the owner or his representatives have the right to an additional charge for this service. Whenever the owners do not offer the possibility of a mid-week cleaning (even at an extra charge) RIT, can provide a mid-week full house keeping service upon request at an extra charge varying depending on the size of the property.


HEATING

Given the laws currently in force in Italy regarding energy supply, the use of heating (when it can be switched on and off, temperature, etc.) is controlled by regulations, which vary from region to region. As an indication, heating appliances may be switched on between November and April. Heating is often not included in the letting price and if this is the case will be charged at a daily rate or by consumption. Heating is usually payable at the end of the holiday according to the amount consumed, unless otherwise stated. If you are planning a trip during Winter or Spring when heating will be required, check the costs before booking.


SWIMMING POOLS

Swimming pools are generally in use between mid May - mid September. Pools are not usually heated (unless otherwise stated) and opening / closure is dependant on each individual owner and also on the weather. If a pool is important during your stay please check with us on booking as to the opening / closure dates for the particular property booked. Opening / closure is not under our control as it is the decision of each property owner and we cannot be held responsible for their decision.


EXTERNAL MAINTENANCE

The owner or his representative reserve the right to have free access to the property for essential maintenance purposes (garden, swimming pool etc.).


CHANGES - CANCELLATION CHARGES

In the case of alterations to a booking such as a change in the number of persons, days or the dates, RIT, or the property owner or his representatives reserve the right to charge the full cancellation fee as it appears on the web pages. If you cancel your holiday the lead name on the booking must advise us in writing, by post or by facsimile to +39 0577 355 255 immediately. Verbal cancellations or cancellations by email will not be accepted. If you cancel your holiday, you will be liable to pay the cancellation charges set out in the chart below. The base administration fee of Euro 50 is not refundable. Cancellation periods are calculated on the date of your cancellation being received by post to our offices in Italy at Rent in Tuscany, Via Roma 15/17, Castelnuovo Berardenga, SI 53019, ITALY or by facsimile at +39 0577 355 255.


When period before scheduled arrival date is:

* Up to 7 weeks to vacation date: 50% of deposit (minus Euro 50)

* Up to 3 weeks to vacation date: 40%

* Less than 3 weeks to vacation day: No reimbursement




If you cancel your holiday on the day of arrival due to circumstances beyond our control, compensation or refunds will not be payable by ourselves and any such claims should be forwarded to your insurers.

Should you decide to curtail your holiday arrangements, for whatever reason, no refunds will be payable for any unused nights of accommodation.

In the case of cancellations due to force majeure, acts of war or terrorism, holidays makers will are reminded that RIT, is acting as a booking agent and can never be held liable for their fees and commissions. The decision to waive the cancellation fee or refund a deposit taken by RIT, on behalf of the property owner or his representatives is entirely at the discretion of the property owner or his representatives.



RESPONSIBILITY

RIT team, have visited and checked each property personally. The descriptions appearing in our web pages are accurate and have been prepared in good faith, RIT, however, declines all responsibility for any modifications made by the owners without its knowledge, unless it is impossible to totally or partially fulfil the contract and that the holidaymaker will not accept the partial fulfilment of the contract. In the event of any problems, the holidaymaker undertakes to do his best to resolve or minimize them in order to avoid any prejudices that could result. If the holidaymaker is unable to do this, he must immediately get in touch with RIT, by telegram or telephone to +39 0577 355 255 or to +39 348 154 3810. He must also confirm his complaints in writing within 24 hours. The holidaymaker is obliged to allow RIT, the time necessary to resolve the problem. Should there be no written complaint supplied as above specified and without an explicit authorisation by RIT, the holidaymakers who leave their accommodation prematurely forfeit their rights for a refund of the rental or letting price, unless there is a legal right for them to have cancelled. Complaints received at the end of the stay will not be taken into consideration and no refunds will be given. If, for any reason beyond its control including force majeure, acts of war or terrorism, RIT, has to cancel the booking made by the holidaymaker, it will offer the holidaymaker another property of equivalent standard and with which the holidaymaker is in agreement. If the price of the alternative property is less, the difference will be reimbursed to the holidaymaker but if the price is higher, the holidaymaker must pay the difference. If however no agreement can be reached, both parties are entitled to cancel. RIT, will refund to the holidaymaker only the letting price paid less the administration fee of Euro 50; no other amounts will become due.


IMPORTANT INFORMATION FOR ALL HOLIDAYMAKERS

RIT offers hand picked unique vacation structures in Tuscany. As you are aware, some of these properties are not official tourist structures, such as hotels or residences but private houses. Given that Tuscany’s architecture is so rich, full of history and varied, we have done our best to categorize the properties we offer under some consistent groupings, to facilitate your choice and your better understanding of our offer. Our categorization reflects the type of architecture and their surroundings and they will be imbued by the personal taste of the owner and the local traditions. For its part, RIT has carefully chosen such properties taking into consideration a standard of excellence and quality which we believe can fulfil and completely satisfy the good taste, demands for quality and needs of a citizen of the world. RIT cannot however exclude the possibility that these differences can sometimes result in minor inconveniences - due to the special nature of its architecture and of traditions in the area - but which cannot be accepted as complaints. RIT, is pleased to be able to offer you this type of holiday: the chance to partake in the culture of the area chosen, living for a few weeks in the same surroundings as a local inhabitant would. In order to live this experience in the right spirit, it is important not only that the holiday-maker accepts but also that he will be able to appreciate the differences in the properties RIT is proposing in comparison with those where he normally lives.


LAW AND JURISDICTION

In the event of controversies arising from the booking and the renting or letting, the Arezzo Law Court only can deal with the matter and Italian law only applies. By agreeing to or signing the booking form and by making the booking, this implies that RIT’s, General Conditions of Renting and Letting have been understood and have thereby been accepted without reserve and without exception. If any of the conditions of this contract have become invalid or were invalid or if in this contract there should be a gap, the other conditions cannot be contested.
